Players Waiver

Welcome to Clutch Performance Baseball. We are excited that you have decided to take advantage of the many useful baseball clinics offered here. Please read very carefully these terms and conditions before registering for one of our clinics. Participation in a Clutch Performance Baseball clinic indicates that you accept these terms and conditions. If you do not accept these terms and conditions, please do not register for a Clutch Performance Baseball clinic. Take a minute to read these Terms of Service to ensure that you understand the terms and conditions of our relationship.

Terms of Service

These Terms of Service are an agreement between Clutch Performance Baseball and the player and/or parent or guardian of the player attending the Clutch Performance Baseball clinic.

Player Participation Waiver

The players and/or parent or guardian, prior to participation in our clinics, must accept the following Terms of Service. (You can download a PDF file of this agreement, along with our Weather Policy and our Refund policy, by clicking here.)

We reserve the right to update or change these Terms of Service at any time and for any reason, however, if we make significant changes to our policies, we will notify registered players by e-mail, post a notice on our home page or alert you to such changes by other similar means. By enrolling in a Clutch Performance Baseball clinic, you agree to be bound by any such revisions and should therefore periodically visit this page of the website and print the latest version of the Terms of Service for your records. For your information, the date of the last update to these Terms of Service is stated at the top of this document.

In addition to these Terms of Service, you should also read and be aware of the provisions of our Weather and Refund Policies.

For the player, (name), the player and/or parent or guardian hereby accepts the opportunity to play in the (clinic event) and agrees to the following terms and conditions:

I am aware and understand that weather is not a factor Clutch Performance Baseball can control in any way. In case of inclement weather Clutch Performance Baseball will do our best to accommodate all customers in times of unforeseen weather conditions and to use every resource available to us to conduct as much of the scheduled events as possible. I understand that there may be no rain date and that in the case of bad weather Clutch Performance Baseball may not be able to complete the event. I understand that I am not entitled to any refund if Clutch Performance Baseball cannot complete the event because of bad weather or any other condition beyond their control. Please see our Weather Policy.

I am aware and understand that I am not entitled to a refund of the registration fee if I as the player and/or my son is unable to attend the clinic because of illness, injury, scheduling conflict or for any other reason. Clutch Performance Baseball offers a full credit toward another clinic when written notice is received no more than 30 days prior to the scheduled clinic. Please see our Refund Policy

I am aware and understand and acknowledge the risks and dangers involved in my and/or my child's participation in the event and assume all risks of injury and damage due to my and/or my child's participation in the clinic. It is further understood that in consideration of me and/or my child being granted permission to participate in the clinic, I hereby release, discharge and relinquish Clutch Performance Baseball, its officers, agents, representatives, employees, volunteers and officials of and from all claims, demands, actions and causes of action of any sort, for any injuries sustained by me and/or my child while participating in the event and agree to hold them harmless and indemnified.

By signing this waiver I acknowledge to Clutch Performance Baseball that I have medical insurance coverage and will be responsible for all medical expenses incurred as a result of participating in the clinic.

I agree to adhere to the rules and regulations of the baseball stadium/field/facility on which the clinic is held including, but not limited to such things as not using alcohol or tobacco products on the grounds or in the parking lots. I understand that I may be removed from the clinic for violating any of these rules.

I am aware and understand that Clutch Performance Baseball will take still photographs and videos of all the participants at their clinics. Your agreement to the Terms of Service affirms your understanding and willingness to be photographed. Clutch Performance Baseball is the owner of these photos, which may be used on our Web site, in videos sold to participants or in our marketing material.

Upon Registering for an event, this agreement will appear and you will need to click a checkbox which will indicate your understanding and agreement to all of the terms and conditions as outlined above..
